Winner is solely responsible for providing accurate shipping information and complying with all local laws and regulations relating to the receipt, registration, ownership, and use of the Prize.
ASSUMPTION OF RISK; LIABILITY RELEASE
THE PRIZE IS AN ELECTRIC BIKE ("PRIZE) AND INVOLVES INHERENT RISKS OF INJURY, SERIOUS BODILY HARM, PROPERTY DAMAGE, AND DEATH.
By accepting, possessing, operating, or using the Prize, the winner voluntarily assumes all risks associated with ownership and use of the Prize.
To the fullest extent permitted by law, Sponsor, its owners, affiliates, officers, directors, employees, agents, distributors, retailers, marketing partners, successors, and assigns (collectively, the “Released Parties”) shall not be liable for any injury, death, loss, accident, property damage, product malfunction, or other damages or claims arising out of or related to:
(a) participation in the Promotion;
(b) receipt, shipment, delivery, possession, ownership, maintenance, or use of the Prize;
(c) operation or misuse of the Prize;
(d) mechanical failure or alleged defect of the Prize; or
(e) any acts or omissions of the manufacturer, shipper, or third parties.
Winner expressly releases and discharges the Released Parties from any and all claims, liabilities, causes of action, damages, costs, and expenses arising from or related to the Prize or Promotion, whether based in contract, tort, negligence, strict liability, or otherwise, to the fullest extent permitted by law
MANUFACTURER DISCLAIMER
Sponsor is not the manufacturer, designer, distributor, or warrantor of the electric bike Prize and makes no representations or warranties, express or implied, regarding the Prize, including without limitation merchantability, fitness for a particular purpose, quality, safety, legality, or performance. Any applicable warranty is solely the manufacturer's warranty.
WINNER VERIFICATION AND ADDITIONAL RELEASES
Potential winner may be required to execute and return an affidavit of eligibility, liability release, publicity release (where lawful), and any additional documentation requested by Sponsor prior to receiving the Prize.
Failure to execute required documents promptly may result in disqualification and selection of an alternate winner.
PUBLICITY RELEASE
Except where prohibited by law, accepting the Prize constitutes the winner's consent for the Sponsor to use the winner’s name, likeness, photographs, social media content, city/state of residence, and statements regarding the Promotion for advertising, promotional, and publicity purposes without additional compensation.
LIMITATION OF LIABILITY
Sponsor is not responsible for lost, stolen, damaged, delayed, misdirected, incomplete, altered, or fraudulent entries, claims, or prize notifications, nor for technical, manufacturing, printing, packaging, or distribution errors.
If the Promotion cannot be conducted as intended due to fraud, error, technical failure, production issue, or any other factor beyond the Sponsor’s reasonable control, the Sponsor reserves the right to modify, suspend, or terminate the Promotion and award the Prize in a manner the Sponsor deems fair and appropriate.
DISPUTES; GOVERNING LAW
Except where prohibited, participants agree that all disputes, claims, and causes of action arising out of or connected with this Promotion or Prize shall be resolved individually and without resort to class action.
These Official Rules shall be governed by and construed under the laws of the State of California, without regard to conflict of law principles.
SPONSOR RESERVES RIGHTS
Sponsor reserves the right to interpret these Official Rules and make all final decisions concerning eligibility, verification, and administration of the Promotion.
TAXES AND EXPENSES
Winner is solely responsible for all federal, state, and local taxes, registration fees, insurance, licensing, title requirements, maintenance costs, or any other expenses associated with accepting, owning, or using the Prize.
